Wanda Simek

COUNSEL


Born and raised in Montreal, Wanda grew up speaking Vietnamese with her maternal grandparents, French with her parents, and English with her brother.  This may explain Wanda’s love of exploring different cultures and foods, and she has been eating her way around the world since her teens. 

Wanda represents corporate and individual clients in matters relating to shareholder and partnership disputes, professional negligence, real estate litigation, construction litigation, and breach of commercial contracts.  In addition, Wanda has over fifteen years of experience in the insurance defence of architects, engineers, directors and officers, realtors, real estate developers, and construction contractors.  She has completed the BC Insurance Council’s General Insurance course and advises clients on insurance coverage and insurance contract interpretation issues.

Wanda previously practiced at a boutique construction litigation firm, the Real Estate Errors and Omissions Insurance Corporation, and a boutique commercial litigation firm.  She is experienced in the courtroom but also respected for devising practical strategies for her clients when navigating disputes and negotiating resolutions outside of the courtroom.

Wanda enjoys providing mentorship to young lawyers, volunteers with the Women Lawyers Forum and Access Pro Bono, and spends her free time chasing after her energetic rescued Thai street dog or skiing in Whistler.

Wanda provides legal services in English and French.

Significant Cases

  1. Yan v Benbow Residences Inc., 2024 BCSC 1828: represented the plaintiff in a claim against the developer/seller of a luxury home for repudiation of the contract, failure to complete the transaction, and return of the deposit.

  2. 1501642 Alberta Ltd. (c.o.b. High End Hotel Construction) v Braza Construction Ltd., 2022 BCSC 391: represented a piling contractor in a claim against a developer for unpaid invoices. The developer counterclaimed for damages relating to construction defects and the improper levelling of the development.

  3. Well Sing Property Development Ltd. v MacDonald Platinum Marketing Ltd., 2021 BCSC 755: represented a real estate brokerage firm in a contractual dispute with a developer for unpaid real estate commissions.

  4. Northern Thunderbird Air Inc. v British Columbia (Workers’ Compensation Appeal Tribunal), [2017] B.C.J. No. 300, 2017 BCCA 60: acted for a respondent in a Workers’ Compensation Tribunal proceeding on the issue of whether the respondent was subject to the workers compensation regime or could pursue damages in a civil action against Northern Thunderbird Air Inc.

  5. M.H. Rent-a-Rod Ltd. (c.o.b. M.H. Development) v Cooper, 2016 BCSC 927: succeeded in application to discharge a builders lien and CPL from title.

  6. Maedou Consulting Inc. v 0887455 B.C. Ltd., 2015 BCSC 2009: defended an application to disqualify a law firm from acting for the respondent in an oppression proceeding.

  7. Lavigne v Ellis, 2014 BCSC 1557: defended a listing realtor against claims of negligence and misrepresentation.

  8. Suri v Radio India Broadcasting Inc., 2008 BCSC 1399: defended a radio station at trial against claims of debt, unpaid wages, oppression, and defamation.

  9. Terrien Bros. Construction Ltd. v Delaurier, 2006 BCSC 1645, 2007 BCCA 623: acted for purchasers suing for damages in connection with a failed real estate transaction between the parties.

  10. Represented a group of company directors in an arbitration proceeding against the company CFO involving allegations of breach of fiduciary duties, fraud and embezzlement.
