David McEwan
COUNSEL
A native of Nelson, British Columbia, David has never been able to understand why Vancouverites use umbrellas when it is snowing. David has been known to rank the aesthetic appeal of BC’s many courthouses and will argue, aggressively, that Nelson belongs at the top of the list.
David maintains a diverse corporate and commercial litigation practice, with a particular focus on shareholder remedies, director and officer liability, professional liability, contract disputes, injunctions, and fiduciary duty claims. He has appeared before all levels of court in British Columbia, and has acted as counsel on a significant number of commercial arbitrations and mediations. In addition to his commercial litigation practice, David has appeared as counsel on several criminal appeals.
David is an active member of the Advocates’ Society and the Canadian Bar Association. When he is not engaged in legal pursuits, David can be found with his wife and dog exploring the North Shore trails, or skiing on the slopes.

Significant Cases
R v Edwards, 2024 SCC 15: represented a non-profit organization in an intervention at the Supreme Court of Canada on a Charter interpretation issue.
Rahman v Windermere Valley Property, 2022 BCCA 258: represented the appellant in the Court of Appeal in a decision that clarified the duty of the courts to accommodate self-represented litigants.
Huang v Li, 2020 BCSC 1727: represented the defendant in a claim involving fraud and unjust enrichment.
LLS America LLC (Trustee of) v Dill, 2018 BCSC 2316: represented an American based trustee in bankruptcy, charged with recovering funds from a Ponzi scheme, in a combined contempt hearing and application for a Mareva injunction.
Fletcher v Norkum, 2018 BCSC 904: represented the defendant in claim in fraud and unjust enrichment arising from the breakdown of a domestic relationship.
