Alina was born and spent her formative years in Ukraine, which may explain her indomitable spirit. Her passion for the practice of law and corresponding inability to chill continues to concern her family and friends. If she is not hard at work for her clients, she is on a plane to discover up-and-coming wine regions in Europe and the Americas.

Alina has a general litigation practice with experience in real estate disputes, construction law, negligence claims, contractual claims, and shareholder disputes. Prior to joining Allen / McMillan, Alina worked at a boutique litigation firm in downtown Vancouver on a wide range of cases including complex high stakes disputes before all levels of court in British Columbia. In addition to her litigation experience, she has also represented clients at mediations and negotiations. 

Alina has extensive advocacy experience, which she has been honing since the start of law school. While in law school, she participated in various moots and negotiation competitions, took intensive advocacy courses, and interned at the University of Ottawa Community Legal Clinic where she provided legal aid to low-income families and students.

Outside of work, Alina enjoys travelling, hiking, tennis, and indulging in different cuisines. She also likes going on long walks around the courthouse and critiquing legally inaccurate shows and movies.

Alina provides legal services in English, Russian, and Ukrainian.

Significant Cases

  1. Yan v Benbow Residences Inc., 2024 BCSC 1828: represented the plaintiff in a claim against the developer/seller of a luxury home for repudiation of the contract, failure to complete the transaction, and return of the deposit.

  2. British Columbia (Chief Inspector of Mines) v Sunrise Resources Ltd., 2023 BCSC 1328: represented the petitioner in a judicial review of an administrative decision of the Environmental Appeal Board in relation to the operation of section 36.6(1) of the Mines Act.

  3. Liang v Barnard, 2022 BCSC 924: represented Vancouver based investors in an energy drink company and a related farming business in successfully defending an application to to stay the dispute in favour of arbitration.

  4. Bajwa v BC Liberal Party, 2022 BCSC 194: represented the petitioner in seeking a short notice injunction to prevent the release of the results of the BC Liberal Party leadership race due to voting irregularities.

  5. Pearce v 4 Pillars Consulting Group Inc., 2021 BCCA 198: represented debt advisors before the British Columbia Court of Appeal. This involved appealing the Supreme Court’s dismissal of their application to strike parts of the claim based on alleged breaches of the BC Consumer Protection Act and the Bankruptcy and Insolvency Act and an application that sought to enforce a clause in the standard form customer contract.  

  6. Rosa Donna Este v Mina Esteghamat-Ardakani also known as Mina Estegahamat-Ardakani, et al, 2019 CanLII 18830 (SCC): represented a party on an application for leave to cross-appeal to the Supreme Court of Canada.

  7. Sandhu v Sidhu, 2019 BCSC 514: represented the defendants in a summary trial application on behalf of the seller related to a contract of purchase and sale of a large, subdividable lot located in Delta, B.C.

  8. Represented an individual in successfully recovering loans on the basis of civil fraud.

  9. Represented a defendant director of a company in a claim alleging breach of his  fiduciary duties.
